Terms of Service (EULA)

1. Agreement and Apple Standard EULA

These Terms of Service ("Terms") govern your use of the DayShape iOS application ("the App"), developed by the DayShape team ("we", "us", "Licensor"). By downloading or using the App, you agree to these Terms.

For use of the App obtained through the Apple App Store, the Apple Standard End User License Agreement ("Apple EULA") applies in addition to these Terms. If any conflict arises between these Terms and the Apple EULA, the Apple EULA prevails with respect to Apple's rights and obligations. Apple is not a party to these Terms and has no responsibility for the App or its content.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, for personal, non-commercial use, subject to these Terms and the Apple Media Services Terms of Use.

You may not: copy, modify, or distribute the App except as permitted by law; reverse engineer the App except where such restriction is prohibited by applicable law; rent, lease, sublicense, or sell the App; or use the App in violation of any applicable law or regulation.

3. Your Data

You retain all rights to the data you create in the App (time entries, categories, goals, schedules, and exports). Your data is stored locally on your device and, only if you enable it, in your private iCloud database. We claim no ownership over your data. You are responsible for maintaining backups; the App provides CSV/JSON export for this purpose.

4. Purchases, Subscriptions, and Free Trial

• Purchases are processed exclusively by Apple via StoreKit / In-App Purchase. All billing, renewal, cancellation, and refund matters are governed by Apple's Media Services Terms and are handled by Apple, not by us.
• Pro is offered as a monthly or yearly auto-renewable subscription, or a one-time lifetime purchase. Where offered, an introductory free trial is available to eligible users; eligibility and conversion to a paid subscription are managed by Apple.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings.
• When a subscription or trial ends, Pro features become unavailable, but your existing records are never deleted and remain fully accessible.

5. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. DayShape is a personal time-awareness tool; it is not medical, health, or productivity advice, and statistics it produces are for personal reference only.

6. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. Our aggregate liability shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

7. Intellectual Property

The App, including its design, code, artwork, and trademarks, is owned by the Licensor and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

8. Changes and Contact

We may update these Terms; material changes will be noted in the App's release notes with an updated date above. Continued use after changes constitutes acceptance.
